We, at Fergus Flanagan Architects, take our obligations to comply with the GDPR regulations regarding Data protection & Control very seriously. Please find our privacy statement below which sets out how we comply with this new regulation, our commitment in respecting your privacy and to protecting your personal data!

Why we need your data
In order to provide an Architectural Service for your project we require various pieces of information from you. At the inception of your project we will off course require basic contact information, however through the various stages of your project we may require further information for example for the planning stage such as your right to live in the area, At Tender / Construction Stage we may require information relating to Financing etc.

We will not request any other information which is not relevant to your building project.

What we need
The information we require depends on the complexity of the project. In basic terms we will need to collect information as follows:  names, addresses, email addresses, telephone numbers, and data which relates to an individual person or persons, this may involve some personal data. We also hold information in our Accounts systems, required on a legal basis, to comply our financial Tax Returns.

What we do with your data
The personal data we collect is processed by our staff and will be retained securely with your project both in Hard form and electronic.

The following are examples of ways in which we might process your data;

– In emails and letters

– In the project brief

– On drawings (physical and PDF/other digital media)

– In models on common data environments/clouds

– In visualisations

– In Marketing brochures / Websites etc in the form of proposed 3d visualisations and as Built images.

Data Shared with Third Parties

Due to the nature of our services, we are regularly required to share some of your personal data with third parties. This will be based solely for the purpose of your project. The following are typical third parties with which we may have to share your information. Planning departments, building control departments, consultants, builders, Health & Safety Authority, please note this list is not exhaustive.

How long we keep your data for

We will hold this information for a period of 6 to 12 years (if under seal), after the completion of your project. If at this stage you wish us to delete the information on file we will happily do so. However, it may be of some benefit to you that we continue to hold your information for future works you may wish to undertake.

What are your rights?
Under the GDPR, as a data provider, your rights are:

The right to obtain details about how your data is processed by an organisation or business

The right to obtain copies of personal data that an organisation holds on you

The right to have incorrect or incomplete data corrected.

The right to have your data erased by an organisation, where, for example, the organisation has no legitimate reason for retaining the data

The right to obtain your data from an organisation and to have that data transmitted to another organisation

The right to object to the processing of your data by an organisation

The right to not to be subject to automated decision making, including profiling

If the User needs to contact Fergus Flanagan Architects for any reason (including to exercise any of its rights in relation to data protection as set out above) please contact
Fergus Flanagan Architects will act on the User’s requests and provide information free of charge, except where the requests are manifestly unfounded or excessive (in particular because of their repetitive nature) in which case Fergus Flanagan Architects may charge a reasonable fee (taking into account the administrative costs of providing the information or communication, or taking the action requested), or refuse to act on the request.
